4. If we cancel or transfer a course

In certain circumstances out of our control, BMW Rider Training may have to postpone a training course in full or part. In such a situation, BMW Rider Training will re-arrange the training course and DVSA test date (if applicable) at a mutually-agreed time with the student.

5. DVSA (Driving Vehicle Standards Agency) Motorcycle Tests or RoSPA Assessment.

BMW Rider Training pre-books external assessments to fit with the timing of the motorcycle training course as booked by the student.

> For Motorcycle Licence Training courses, also referred to as Direct Access courses, these are Practical Motorcycle Tests, Modules One and Two, provided by the DVSA. These are undertaken at an external DVSA test centre and invigilated by a DVSA examiner.
> For Advanced Riding Skills Level 3, or Individual Premium Training where a RoSPA certification has been requested, these are observation and assessment sessions provided by RoSPA. These are undertaken at our Training Centre location and on-road, by a designated RoSPA ward-assessor.

However, students must be aware that on rare occasions the DVSA and/or RoSPA is forced to cancel or withdraw tests, even where they have previously given a written confirmation of the test date. While we are not always advised why, this is most commonly (but not limited to) unforeseen circumstances, unavailability of examiners, industrial action or extremely poor weather conditions.

BMW Rider Training has absolutely no control over such actions by the DVSA and/or RoSPA, and cannot be responsible for the inconvenience caused, nor third-party travel or accommodation costs lost to the student as a result of actions by the DVSA and/or RoSPA.

BMW Rider Training will make every effort to re-arrange training, to suit the needs of the student and to fit an alternative test date, subject to availability. Supplementary travel or accommodation costs incurred for re-arranged training sessions are the responsibility of the student.

Should the student require additional training due to the change of test date by the DVSA/RoSPA, BMW Rider Training reserves the right to charge for this.

6. Motorcycle Models Used, in relation to DVSA motorcycle test categories

a) Upon booking, students are required to provide us with accurate date of birth details, as well as a desired licence category, so BMW Rider Training can allocate an appropriate DVSA motorcycle test to the student.

b) Students aged 19-23 are compulsorily restricted to the A2 licence, under UK vehicle licencing legislation.

> Where this is completed, students will be eligible to return to complete their full A licence upgrade after two years, OR upon reaching 24 years of age, whichever passes first.
> BMW Rider Training will provide one subsequent day of training, and one Module 1 & one Module 2 test free of charge. This offer may be referred to elsewhere in BMW Rider Training communications as the A2-to-A Upgrade Package.

c) Students aged 24 and over are eligible for the unrestricted ‘A’ licence but may electively choose the ‘A2’ restricted licence.

> The student may elect to switch to the A2 licence category any time, up to the commencement of the training course, by contacting us in writing by email to BMW@WorldofBMW.com.
> Once the training course has commenced, the student may elect to switch to the A2 licence category agreed in conjunction with your instructor and/or Training Centre management at a suitable time during the course. The course will then continue on to test unaffected.

d) Where the elective A2 licence is successfully achieved for a student over the age of 24, a range of options to upgrade to the A licence at a later date will be provided, subject to extra cost.

e) Where the student has booked our ‘DAS Unlimited – Guaranteed Pass’ package, please note this is applicable to the initial course booking only, irrespective of licence category achieved, and non-transferrable to any future licence upgrade. Should the student wish to increase their entitlement at a later date, they are responsible for any further training costs and subsequent DVSA test fees.

7. Your Safety and Responsibilities

a) Statistics show that motorcycle riding, by its very nature, involves a high degree of risk that can lead to personal injury or death. When booking a course or a lesson, students must accept these attendant risks and hazards.

b) You, the Student, are responsible for always acting in accordance with the directions and advice given to you by your instructor during your training sessions. You are also responsible for making sure that you are adequately dressed and protected for motorcycle riding.

c) You are obliged to inform us of any physical or medical condition or otherwise that could adversely affect safety or training.

d) You must bring your UK photocard driving licence with you for all sessions during any training course booked. It is your responsibility to ensure that your UK driving licence is valid and in your possession for training. Should your licence not be valid or you do not bring it to the course, then you will not be able to take the course and you are not entitled to a refund. If you are in possession of an old-style 'paper' licence supplied prior to the introduction of the photocard type currently in use, you must bring another form of formal photo identification to support your licence. Only the following forms are accepted: a valid UK passport, a Proof of Age Card bearing a PASS hologram, a Ministry of Defence identity card, or a National identity card issued by an EU member state.

e) If you have booked a Direct Access Course and are eligible under UK law to achieve the unrestricted 'A'-category licence, the decision to upgrade you to the larger 'A Category' motorcycle rests solely with your instructor. On rare occasions, a student may not reach the level of skill required to move onto the larger capacity model within the timescales of a normal course, or to complete the CBT (maximum days 1 to 2 of our 6- or 7-day Direct Access training course options). If such a situation arises, the instructor will explain the alternatives open to the student on a case-by-case basis. Certain options may mean additional training or extra DVSA test costs to the student and are subject to instructor availability, which is not guaranteed. No refund will be made if you are not able to complete your CBT or Direct Access Course.

f) For Motorcycle Licence Training courses, also termed as Direct Access courses, BMW Rider Training will not upgrade the student to a larger capacity motorcycle unless we are completely satisfied that you are able to handle the machine safely. If for whatever reason, the student fails to handle a larger-capacity machine safely, then we reserve the right to restrict them to a smaller motorcycle model. No refund will be made.

g) For all other courses, BMW Rider Training will not upgrade students to a larger capacity motorcycle unless we are completely satisfied that they are able to handle the machine safely, irrespective of the model chosen when booking. No refund will be made.

h) BMW Rider Training reserves the right to cancel any tuition should there be a suspicion that the student is under the influence of drink or drugs, or if the student is not legal to ride on the road (e.g. you fail an eye test). BMW Rider Training also reserves the right to stop tuition at any time when the student is not safe on the road and is not acting in accordance with instructions. No refund of fees will be made in such a situation.

i) For one-day CBT re-certification courses, Advanced Riding Skills courses or Individual Premium Training where the student is supplying their own motorcycle to use during our training courses, it is the responsibility of the student to ensure that it meets with all legal requirements for being on the road. Students must provide proof of insurance and MOT (where applicable). Should a student arrive for training on a machine that is not legal (e.g, the number plate does not meet legal requirements)the instructor will restrict training to our on-site private training areas, and will not be able to conduct any on-road training. In such a scenario, no refund of fees will be made in such a situation, and students will be responsible for re-booking and additional payment for any additional training required.

j) Please be aware, if the student incurs any penalties or fines whilst riding BMW Rider Training hire bikes, due to improper manner of riding on the road, these will be charged directly to the student via the original method of payment when booking.

8. Our Responsibilities

a) For Motorcycle Licence Training (Direct Access) and CBT courses, we will provide students with practical motorcycle training in accordance with the DVSA approved training standards. For Advanced Riding Skills and Individual Premium Training, we will provide practical motorcycle training in accordance with RoSPA (Royal Society for the Prevention of Accidents) standards.

b) For all courses, where the student has hired a motorcycle, we will provide a motorcycle that is appropriate for the students licence entitlement under UK law, is compliant with all legal requirements in England & Wales, and is roadworthy. BMW Rider Training will make every effort to meet a preference expressed when booking for a particular model for optionally-chosen Hire Bikes, but we are unable to guarantee this.

c) For Motorcycle Licence Training (Direct Access) courses, BMW Rider Training does not provide any guarantee that the student will pass their DVSA Module One or Module Two practical motorcycle tests. During an Intensive Motorcycle Licence training course, if the student is unsuccessful when attempting the Module One test, they will not be able to attempt the Module 2 test, will forfeit the associated DVSA test fee. Should the student fail either the Module One or Module Two test, it is the responsibility of the student to pay the costs of any additional training, the DVSA test fees and any travel or subsistence costs.

d) For DAS Unlimited Motorcycle Licence Training courses, BMW Rider Training will provide additional training days and DVSA Module One & Two tests at no additional cost until you have achieved the licence category agreed at the time of booking.

> The volume of additional training days required is assessed case-by-case, recommended by a senior instructor, and booked on a mutual diary basis over a period of up to 6 months after the commencement of the initial training course as booked.
> If the student is unable to complete the test requirements for the licence category agreed during this 6 month period, BMW Rider Training is unable to provide any refund.
> If the student wishes to continue after this, the costs of any additional training, the DVSA test fees and any travel or subsistence costs following this are their responsibility.

9. Liability

a) Although every effort is made to ensure student safety during training, students must realistically accept that there is a possibility that an accident may occur that causes loss, damage, expense, personal injury or death to them. Unless shown to be negligent, the instructor and/or BMW Rider Training is not liable for any expenses, loss, damage, personal injury or death as a result of any accident that may occur.

b) Our liability is limited to any damage caused to the student by our failure to perform the contract or by our improper performance of the contract unless the failure or improper performance was the fault of the student or any other third party or was due to unusual or unforeseeable circumstances which could not have been avoided and this liability is limited to the price paid for the training course.

10. Complaints

If the student(s) has a complaint about the training course, in the first instance they must inform the Chief Instructor as soon as is practical, so that remedial action can be taken if possible.

If, however, the student is not satisfied with the response from the Chief Instructor, they should put their comments in writing within 30 days of the training course termination date, quoting the course identity and dates to: World of BMW Programme Manager, BMW Motorrad UK Summit ONE, Summit Ave, Farnborough GU14 0FB
